BOOKINGS.
When a booking is made with us, the booking form must be completed and
signed. This person signing should be the group's leader. He or she must
be over 21, and authorized by all members of the group who are listed on
the booking form, to accept the booking conditions on their behalf. All
communication will be made with the leader of the group, who should duly
pass on to the other group members any relevant information. Upon
receipt of the completed booking form, confirmation of the booking will
be sent to you in writing, please check carefully to ensure it is
correct, if not please inform us immediately. Our home is booked solely
for the use of those persons named on the booking form unless agreed in
writing with us. Once we have sent confirmation to you, we have a
binding contract.
OCCUPANCY
Maximum capacity of the villa is 10 persons and in order to comply
with the State of Florida fire regulations this must not be exceeded.
The renters must treat the property, it's furniture, fittings, utensils
and other facilities with respect. Any loss or damage must be reported
immediately to the Management Company. The group's leader is responsible
for paying for losses, damage or breakages. The owners reserve the right
to withhold any funds from the security deposit to pay for any loss or
damage caused to the property or its contents by any member of the group.
The villa is available for occupancy from 5pm on the day of
arrival until 10am on the day of departure. You agree to permit
the Management Company or their Agents reasonable access to the
property to carry out any necessary maintenance.
Please note
NO PETS ARE PERMITTED unless prior written
agreement is made with the owners.
PAYMENTS AND
DEPOSITS
A non-refundable deposit of £100
per week is required. The outstanding balance is payable 10 weeks
prior to the start of your occupancy. For bookings made less than 10
weeks prior to the start of your occupancy, the full balance is due
immediately. A security deposit of £150 is to be paid with balance and will be refunded to you at the end of your stay if no damages are reported.
CANCELLATION
- BY YOU
If any member of your group needs
to cancel the booking, we would ask that we be informed immediately in
writing or email, duly countersigned by the group leader. Cancellation
will be effective from the date it is received by us. Cancellations are
subject to charges detailed below as a percentage of the total amount
due dependent on the time you cancel.

Note For most reasons beyond your control cancellation will be
covered by your travel insurance. But cancellation due to financial
reasons or no longer wishing to travel is unlikely to be included in
your travel insurance.
CANCELLATION - BY US
In the unlikely event that due to
circumstances beyond our control, we need to make changes to or cancel
your booking, we will inform you as soon as possible. We reserve the
right to cancel any bookings at any time, and will only be held liable
to refund Monies already paid by you the client. (Including the £150
security Deposit). In cases of ‘force majeure’ your booking may need
to be terminated prior to the scheduled conclusion of your booking. This
however is extremely unlikely to occur although if the situation arises
we will not be able to offer refunds, pay compensation or reimburse you
for any expenses you may incur. Your travel insurance may cover you for
these events.
SWIMMING POOL
Additional Pool heating can be requested at time of booking or direct with our management company
on a day by day basis upon arrival. Please understand that it is not possible to guarantee
the temperature of the pool which to some degree is dependant on the
local weather.
All
children must be supervised at all times, and also caution must be taken
around wet areas. The owners and management company do not accept
responsibility in the event of injury or death caused as a result of the
use of the pool.
For your safety glass is not permitted in the
patio/pool area. If any person(s) shall be unable to use the
swimming pool at the villa due to repair or maintenance for a period in
excess of 7 days there will be a refund made of 5% of the daily rental
charge for each day the pool is unusable. No such refund will apply to a
period of 7 days or less. The owners and their agents do not accept
liability for injury howsoever caused, during the use of the pool and
the surrounds of the pool. Guests are expressly forbidden to allow
children to use the pool without adult supervision. Under the terms of
our Florida state hotel/motel licence, the pool door is alarmed for the
protection of children. This alarm should not be tampered with and a
fine will be imposed if this rule is ignored.
SMOKING
There is a no smoking policy inside the villa and the garage, but guests may smoke around the pool and gardens.
WEBSITE AND BROCHURE DESCRIPTION
Whilst
all information supplied on the website and in our brochure is believed to be correct and to
the best of our knowledge, it is understood that the information
supplied is for guidance purposes only and does not form part of any
contract.
COMPLAINTS
Things do occasionally go wrong, and we
promise you we will make our best efforts to rectify faults to your
satisfaction. Please inform our local management company quickly to
allow them to get the problem rectified as soon as possible. If you
are not satisfied with the solution please let us know in writing (or
email). We will not accept liability for any dissatisfaction or other
complaints not reported to our local manager during your stay.
FORCE MAJEURE
Unfortunately we
cannot be held responsible nor accept any liability where
we are prevented from fulfilling our contractual obligations by "force
majeure". These include but are not limited to, war, threat of war, civil
commotion or strife, hostilities, strikes and other industrial disputes,
natural disaster, fire, acts of God, terrorist activities, technical
difficulties with transportation and utilities, closure of ports or
ferries, quarantine, epidemics, weather conditions, government action or
other events outside our control. Your travel insurance may cover you in
some of these events.
GOVERNING LAW
This agreement shall be construed in accordance
with and governed by the law of England and Wales and each party agrees
to submit to the non-exclusive jurisdiction of the courts of England and
Wales.
LIABILITY
WE
DO NOT ACCEPT LIABILITY FOR ANY INJURY,
DAMAGE OR LOSS SUSTAINED BY ANY MEMBER OF YOUR GROUP OR ANY PERSON WHO
ENTERS INTO THE VILLA DURING YOUR CONFIRMED RENTAL PERIOD EITHER BY YOUR
INVITATION OR NOT, EXCEPT WHERE ANY PERSONAL INJURY OR DEATH IS
ATTRIBUTABLE TO OUR NEGLIGENCE.
INSURANCE
IT
IS STRONGLY RECOMMENDED THAT YOU AND ALL MEMBERS OF YOUR PARTY TAKE OUT
HOLIDAY TRAVEL/MEDICAL INSURANCE TO COVER CANCELLATION FEES AND ANY
OTHER LOSSES THAT MAY OCCUR. IT IS YOUR RESPONSIBILITY TO ENSURE THIS IS
SUFFICIENT.
PASSPORTS
From October 2004, all
British visitors must have their own machine readable (i.e. the red EEC
style) passports, children are not able to travel on their parents
passport from October 2004.
